This Privacy Policy explains how nudgy team ("nudgy," "we," "us," or "our") collects, uses, shares, and protects personal information when you use the nudgy application, website at nudgychat.com, and related services (collectively, the "Services").
This Policy must be read together with any just-in-time notice shown when a feature requests sensitive data or device permission. Our actual practices, app permissions, third-party SDKs, Google Play Data Safety disclosures, and this Policy should remain consistent.
1. Information We Collect
Depending on the features you use, we may collect:
- Account information: email address, username, profile information, age-range or eligibility confirmation, and authentication data.
- User Content: prompts, chats, generated outputs, characters, posts, images, audio, video, and files you choose to submit.
- Support and communications: messages, feedback, reports, and information you provide when contacting us.
- Transaction information: purchase status, product identifiers, and transaction records. Payment card details are generally processed by the app store or payment provider rather than nudgy.
- Device and usage information: device type, operating system, app version, language, approximate location derived from IP address, identifiers, crash logs, diagnostics, feature interactions, and access times.
- Safety information: reports, moderation signals, content classifications, and records reasonably needed to detect abuse, enforce our rules, or protect users.
- Information from connected services: limited information received when you choose a third-party sign-in or integration, according to the permissions you grant.
We do not access photos, microphone input, camera data, contacts, or precise location unless the relevant feature requires it, you take an affirmative action or grant permission, and the access is disclosed in context. You can manage device permissions in your device settings, though some features may then be unavailable.
Do not upload another person's image, voice, or personal information unless you have their permission and a lawful basis to do so.
2. How We Use Information
We use information to:
- provide, maintain, personalize, and troubleshoot the Services;
- process requests and generate requested content;
- authenticate users and manage accounts and purchases;
- provide customer support and service communications;
- detect, prevent, and investigate fraud, security incidents, prohibited content, and misuse;
- moderate public or shared content and enforce our Terms;
- analyze performance and improve reliability, accessibility, and features;
- comply with legal obligations and protect rights and safety; and
- send marketing communications only where permitted, with an option to unsubscribe.
We do not use private User Content to train general-purpose AI models unless this is clearly disclosed and we obtain any consent required by applicable law. If an optional model-improvement setting is available, its scope and controls will be explained before participation.
Our legal bases, where required, may include performing our contract with you, your consent, compliance with law, and our legitimate interests in operating, securing, and improving the Services, balanced against your rights.
3. How We Share Information
We may share information with:
- Service providers that support hosting, AI processing, storage, analytics, authentication, payments, customer support, communications, and security, subject to appropriate contractual restrictions;
- Affiliates that help operate the Services under protections consistent with this Policy;
- Other users, only when you choose to publish or share content or profile information;
- Authorities or other parties when reasonably necessary to comply with law, respond to valid legal process, enforce our Terms, investigate abuse, or protect rights and safety;
- Transaction participants in a merger, financing, acquisition, reorganization, or sale of assets, subject to applicable law; and
- Other parties with your direction or consent.
We do not sell personal information for money. If our use of advertising or analytics technologies is considered a "sale," "sharing," or targeted advertising under applicable law, we will provide required disclosures and choices.
4. Public and Shared Content
Content you set as public or share with others may be viewed, copied, or further shared by those users. Public content may remain visible in copies, reports, or other users' interactions even after you delete the original. Do not publish information you want to keep private.
5. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described here, including providing the Services, maintaining security, resolving disputes, and meeting legal obligations. Retention periods vary by data type and context.
When you delete content or your account, we delete or de-identify associated personal information within a reasonable period unless retention is required or permitted for legal compliance, fraud prevention, security, chargebacks, enforcement, or protection of users. Residual copies may remain temporarily in backups and logs until routinely overwritten.
6. Your Choices and Rights
Depending on where you live, you may have rights to access, correct, delete, obtain a copy of, restrict, or object to certain processing of your personal information, withdraw consent, or appeal a denied request.
You may:
- update available account information in the app;
- manage device permissions through your device settings;
- unsubscribe from promotional emails using the link in the message; and
- submit a privacy request at support@nudgychat.com.
We may need to verify your identity before completing a request. We will respond within the period required by applicable law.
7. Account and Data Deletion
If account creation is available, you can request deletion of your account and associated data through the in-app account settings and through the account-deletion page at https://nudgychat.com/account-deletion. You may also contact support@nudgychat.com.
Deleting an account does not automatically cancel an app-store subscription; follow the subscription-management instructions provided by Google Play or the applicable store. We may retain limited records where required or permitted for security, fraud prevention, dispute resolution, or legal compliance, as described in Section 5.
8. Children and Teenagers
The Services are not directed to children and are available only to users who are at least 18 years old, or the age of legal majority where they live if higher. We do not knowingly collect personal information from children. If we learn that an ineligible minor has provided personal information, we will take reasonable steps to delete it and close the account. Reports may be sent to support@nudgychat.com.
9. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee absolute security. Please use a unique password and notify us if you suspect unauthorized account activity.
10. International Data Transfers
Information may be processed in countries other than the one where you live. Where required, we use legally recognized safeguards for international transfers, such as approved contractual clauses.
11. Third-Party Services
Third-party services have their own privacy practices. Review their policies before providing information to them. We are not responsible for services we do not control.
12. Changes to This Policy
We may update this Policy to reflect changes in our practices, the Services, or the law. We will post the revised version and update the "Last Modified" date. We will provide additional notice for material changes where required.
