CSAE Policy

This Child Sexual Abuse and Exploitation (CSAE) Policy applies to the nudgy application, website at nudgychat.com, and all related services (collectively, the "Services"). It supplements our Terms of Use, Data Deletion Agreement, and Privacy Policy.

1. Zero-Tolerance Commitment

nudgy has zero tolerance for child sexual abuse and exploitation. We strictly prohibit the creation, possession, request, solicitation, distribution, promotion, or linking of child sexual abuse material (CSAM), as well as grooming, sextortion, trafficking, or any conduct that places a child at sexual risk.

We may remove prohibited content, restrict or permanently terminate accounts, preserve relevant evidence, and report apparent violations to competent authorities as required or permitted by law.

2. Definitions

  • Child or minor: any person under 18 years old, regardless of the local age of consent.
  • CSAE: sexual abuse or exploitation of a child, including grooming, coercion, sextortion, trafficking, enticement, or other conduct that places a child at sexual risk.
  • CSAM: any visual depiction of a child engaged in sexually explicit conduct, including real, illustrated, AI-generated, manipulated, or deepfake material.

3. Prohibited Content and Conduct

Users must not use the Services to:

  • create, upload, request, trade, distribute, store, or link to CSAM;
  • sexualize a child, a person presented as a child, or an adult altered to appear under 18;
  • groom, entice, coerce, threaten, or sexually exploit a child;
  • request sexual images or sexualized interactions from a child;
  • facilitate child trafficking or commercial sexual activity involving a child;
  • share instructions, coded terms, links, or other methods intended to locate, create, conceal, or distribute prohibited material; or
  • evade safety systems through fictional framing, role-play, age ambiguity, altered media, euphemisms, or generative AI.

The fact that content is fictional, artistic, generated by AI, or presented as role-play does not make sexualized content involving minors acceptable.

4. Age Restrictions

The Services are intended only for users who are at least 18 years old, or the age of legal majority where they live if higher. Users must provide truthful age information. We may use proportionate age-assurance measures and may restrict or close an account when we reasonably believe the user is ineligible or has misrepresented their age.

5. Reporting and Protective Actions

Users can report suspected CSAE, CSAM, or child-safety concerns through available in-app reporting controls or by emailing support@nudgychat.com. Please provide relevant account information, links, or descriptions, but do not download, forward, attach, or redistribute suspected CSAM.

If a child is in immediate danger, contact local emergency services or law enforcement.

Reports involving child safety receive priority. Depending on the circumstances, we may block requests or outputs, remove content, freeze or terminate accounts, preserve records, and take other protective actions while a review is pending.

6. Detection, Moderation, and Enforcement

We may use automated safety systems, user reports, and trained reviewers to identify potential violations. Enforcement may include content removal, feature restrictions, account suspension, permanent account termination, and measures intended to prevent repeat abuse.

We do not disclose confidential detection methods or guarantee that every violation will be identified immediately.

7. Legal Reporting and Cooperation

Where required by applicable law, nudgy will report apparent CSAM or child exploitation to the National Center for Missing & Exploited Children (NCMEC), law enforcement, or another competent child-safety authority. We may cooperate with lawful investigations and valid legal process.

8. Evidence Preservation and Privacy

We preserve only information reasonably necessary to meet legal obligations, protect users, investigate abuse, support enforcement, and respond to lawful requests. Access to child-safety records is restricted to authorized personnel and service providers with a legitimate need to know.

Retention and disclosure are handled in accordance with applicable law and our Privacy Policy. Protective or legal preservation obligations may limit deletion while a child-safety investigation is pending.

9. Generative AI and Third Parties

AI-generated or manipulated content that sexualizes a child, depicts a child in sexually explicit conduct, or makes an adult appear to be a minor in sexualized content is strictly prohibited. Third-party providers supporting the Services must comply with applicable child-safety requirements and contractual safeguards.

10. Appeals

A user who believes an enforcement decision was made in error may contact support@nudgychat.com with relevant information. Protective actions may remain in effect during an appeal, particularly when a child-safety risk is involved.

12. Policy Updates

We may update this Policy to reflect changes in law, platform requirements, safety practices, or the Services. We will post the revised version and update the "Last Modified" date.
